HAMMOND HILL SUBURBAN CLUB WAIVER, RELEASE, AND INDEMNITY
WAIVER & RELEASE OF CLAIMSI understand and agree that in consideration for use of the Hammond Hill Suburban Club and participation in activities on/at the Hammond Hill Suburban Club, I hereby waive and forever discharge any and all liability claims and demands of whatever kind or nature against Hammond Hill Suburban Club, its agents, representative, officers, directors, employees, instructors or Board of Governors (“Released Party”), either in law or in equity, including but not limited to damages or losses causes by the negligence, fault or conduct of any kind of the Released Party. This waiver and release includes but is not limited to death, bodily injury, illness, economic losses or out of pocket expenses, or loss or damage to property. I understand and agree that this waiver and release is binding on my heirs, assignee, next of kin and/or legally appointed or designated representatives and is intended to apply to and include any claims that may hereinafter accrue or arise from my participation in these activities. I agree and intent that this release and waiver is to be interpreted to provide full release of liability to the fullestextent permitted by law and waive any claim that I may have.
COVID-19By signing this form Iagree and understand that my participation in activities at Hammond Hill Suburban Club include possible exposure to and illness from infectious diseases including but not limited to COVID-19; I knowingly and freely assume all such risks related to illnesses such as COVID-19 even if arising from the negligence or fault of Hammond Hill Suburban Club, its agents, representative or employees, and hereby release, waive and forever discharge any and all liability claims and demands of any kind or nature against Hammond Hill Suburban Club, its owners, successors, heirs, assigns, agents, employees and the Hammond Hill Suburban Club Board, for myself, my guests and any minors in my custody at Hammond Hill Suburban Club, for any illnesses or infectious disease exposure while present at Hammond Hill Suburban Club.
ASSUMPTION OF RISKBy signing this form, I agree to assume all risks arising from activities associated with use of the Hammond Hill Suburban Club, even those allegedly caused by the negligence or conduct of Hammond Hill Suburban Club agents, officers, representative and/or employees. I understand that there are inherent risks associated with the use of the Hammond Hill Suburban Club which may be both foreseen and unforeseen and include but not limited minor injuries such as bruises, sprains and dehydration, major injuries such as back injuries, heat stroke, heart attack, serious injury or potentially catastrophic or fatal injuries such as paralysis or death. I have read the and understand the inherent dangers associated with the activities, specifically Swimming, Volleyball and Pickle Ball, played at Hammond Hill Suburban Club and I knowingly and voluntarily assume the risks associated with these activities.
INDEMNITYBy checking/signing this form I agree to Indemnify and hold harmless Hammond Hill Suburban Club, its owners, successors, heirs, assigns, agents, employees and the Hammond Hill Suburban Club board, from all liability for any loss, damage, injury, illness, death and/or expenses that I or any person(s) in my care, custody or present under my Hammond Hill Suburban Club association, may suffer arising out of the use of the Hammond Hill Suburban Club facilities and grounds.
MONTCLAIR COURTS WAIVER, RELEASE, AND INDEMNITY
WAIVER & RELEASE OF CLAIMSI understand and agree that in consideration for use of the Montclair Courts and participation in activities on/at the Montclair Courts, I hereby waive and forever discharge any and all liability claims and demands of whatever kind or nature against Montclair, its agents, representative, officers, directors, employees, instructors or Board of Governors (“Released Party”), either in law or in equity, including but not limited to damages or losses causes by the negligence, fault or conduct of any kind of the Released Party. This waiver and release includes but is not limited to death, bodily injury, illness, economic losses or out of pocket expenses, or loss or damage to property. SOUTHERN PICKLEBALL ASSOCIATION/GEORGIA PICKLEBALL LEAGUE WAIVER, RELEASE, AND INDEMNITY
In consideration of becoming a member or being allowed to participate in the Southern Pickleball League tournament hosted by Georgia Pickleball League and the Southern Pickleball Association I do hereby for myself, my heirs, assigns, executors, and administrators, waive, release, covenant not to sue, and forever discharge the Georgia Pickleball Association and the Southern Pickleball Association (hereafter “the hosts”, as well as its employees, coordinators, event managers, event directors. volunteer staff, and agents from liability from any and all claims resulting in personal injuries, death, accidents, illnesses (such as communicable diseases including COVID-19), and property loss arising from, but not limited to, participation in the Event.
RELEASE In consideration of being permitted to participate in the tournament (“the Event”), I, for myself, my heirs or assigns, hereby release, waive, discharge and covenant not to sue the hosts as well as it coordinators, event managers, event directors, volunteer staff, officers, employees, and agents from liability from any and all claims resulting in personal injuries, death, accidents, illnesses (such as communicable diseases including COVID-19), and property loss arising from, but not limited to, participation in the Event.
ASSUMPTION OF RISK Participation in the Event carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. The specific risks vary but include 1) minor injuries such as bruises, sprains, and dehydration, 2) major injuries such as eye injuries, joint or back injuries, heatstroke, heart attacks, and concussions, and 3) catastrophic injuries such as paralysis and death. I have read the previous paragraphs and I know, understand, and appreciate these and other risks that are inherent in playing pickleball. I assert that my participation is voluntary and that I knowingly assume all such risks.
INDEMNIFICATION AND HOLD HARMLESS I also agree to indemnify and hold the hosts, and all named above harmless from any and all claims, actions, suits, costs, expenses, damages, and liabilities, including attorney’s fees brought as a result of my involvement in the Event.
USE PERMISSION I also give the hosts and its agents and designees permission to use or distribute, without limitation or obligation, my image, name, voice, and words for any purpose connected with the Event, including promotional, marketing, training, informational, and archival uses.
